Terms of Use

These Terms of Use ("Terms") govern your access to and use of Kaun, including the Kaun mobile applications for iOS and Android, website, and related services (collectively, the "Service").

Kaun is operated by Hans Wilhelm Beramo Salangsang, doing business as Kaun, an individual proprietor in the Philippines. For legal notices, Kaun may be contacted through support@getkaun.com or by mail at San Jose del Monte City, Bulacan 3023, Philippines.

By accessing or using the Service, you agree to these Terms. If you do not agree with them, you must not use the Service.

1. The Service

Kaun is a meal-planning and recipe application designed to help you discover recipes, create and manage meal plans, organize grocery lists, create or remix recipes, import recipes from supported URLs, and share certain content.

We may add, change, suspend, or discontinue features of the Service from time to time. Some features may be available only to subscribers of Kaun Plus.

Kaun is not a medical, healthcare, nutritional, dietary, allergy, or professional food-safety service. Recipe and ingredient information is provided for general informational purposes. You are responsible for deciding whether food, ingredients, preparation methods, or recipes are appropriate for you and anyone consuming the food.

Some recipes and images included with Kaun (including starter or bundled recipes) may be created or assisted by automated tools, including artificial intelligence, or may come from stock photography. They are for general meal-planning inspiration. They may be inaccurate, incomplete, or not depict the exact dish. They are not a substitute for checking ingredients, allergens, and food-safety practices yourself.

Recipes you create, remix, import, or share are your content or the original third party's content, not Kaun-authored artificial-intelligence content.

Allergen and dietary tags (including labels such as Nut-Free or Gluten-Free) and any ingredient or allergen filters in Kaun are convenience tools only. They can be wrong or incomplete. Kaun does not guarantee that a recipe is free of any allergen or suitable for any dietary or medical need. Always read the full ingredient list before cooking or eating.

2. Eligibility

You must be legally permitted to use the Service under the laws applicable to you.

Kaun is not directed to children under 13. If you are under 13, you may not use the Service. If applicable law requires a higher minimum age for a particular feature or service, that requirement applies.

3. Using Kaun

You may use Kaun for your personal, non-commercial meal-planning and cooking purposes, subject to these Terms.

You agree not to:

• use the Service for unlawful, fraudulent, abusive, or harmful purposes;
• interfere with or disrupt the Service or its infrastructure;
• attempt to gain unauthorized access to accounts, systems, or data;
• reverse engineer, decompile, disassemble, or attempt to extract source code from the Service except where applicable law expressly permits it;
• scrape, crawl, harvest, or systematically collect content or data from the Service without permission;
• bypass technical restrictions, usage limits, subscription controls, or other access controls;
• use the Service to distribute malware, malicious code, spam, or other harmful material;
• impersonate another person or misrepresent your relationship with Kaun;
• use Kaun's content or Service to build or operate a competing service where doing so would violate applicable law or Kaun's rights; or
• use the Service in a manner that could reasonably damage Kaun, its infrastructure, users, or third-party service providers.

We may take reasonable measures to prevent or address misuse, including restricting access to affected features or accounts.

4. Guest Use and Accounts

Some Kaun features may be used without creating an account.

Certain features, including Kaun Plus, require you to sign in. Kaun supports passwordless authentication methods such as email verification codes and supported third-party sign-in providers.

You are responsible for maintaining control of the email address or authentication method associated with your account and for activity occurring through your account.

You must provide information that is accurate and not misleading when creating or maintaining an account.

Signing in does not mean that Kaun automatically backs up or synchronizes your private recipe library or other local application data to the cloud. Certain account and server-side features may use Kaun's servers as described in the Privacy Policy.

5. Local Data

Kaun is designed to work offline for substantial portions of the application.

Recipes, meal plans, grocery lists, and other application data may be stored locally on your device. Unless expressly stated otherwise, local data is not a cloud backup.

You are responsible for maintaining your own device backups where appropriate.

Deleting the Kaun application, changing devices, losing your device, or otherwise losing local application data may result in permanent loss of locally stored content.

Kaun does not guarantee that locally stored data can be recovered.

6. Your Content

You may create, enter, upload, save, or otherwise provide content through Kaun, including recipes, descriptions, meal plans, grocery lists, photographs, and other material ("User Content").

You retain your ownership rights in User Content that you own.

You grant Kaun a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use your User Content only as reasonably necessary to:

• provide and operate the Service;
• store and display your content;
• provide sharing functionality that you request;
• process recipe images and other content you upload;
• maintain, secure, troubleshoot, and improve the Service; and
• comply with applicable law.

This license ends when the relevant User Content is deleted from Kaun's systems, except to the extent retention is reasonably necessary for legal, security, backup, dispute-resolution, or other legitimate operational purposes.

Kaun does not claim ownership of your original User Content merely because you use the Service.

7. Responsibility for User Content

You are responsible for the User Content you create, upload, import, or share.

You represent that you have the rights and permissions necessary for Kaun to process that content as described in these Terms.

You must not upload or share content that:

• infringes another person's intellectual property or other rights;
• unlawfully contains another person's personal information;
• is fraudulent, malicious, or unlawful; or
• violates applicable law.

Kaun does not routinely review all User Content before it is stored or shared. We may remove, restrict, or disable access to content where reasonably necessary to address legal obligations, abuse, security concerns, or violations of these Terms.

8. Sharing

Kaun may allow you to create shareable links for recipes, grocery lists, meal-plan templates, or other supported content.

When you create a share link, the content necessary to provide that link may be stored on Kaun's servers and made accessible to people who obtain the link.

You should not share information through a public or shareable link that you do not want others to see.

Anyone who obtains a functioning share link may potentially access the content available through that link. Kaun may allow shared content or links to expire or be deleted.

Deleting your Kaun account does not automatically take down an existing share link.

Kaun is not responsible for how another person uses information that you voluntarily make accessible through a share link.

9. Recipe Imports and Third-Party Content

Kaun may allow you to import recipe information from third-party websites or URLs.

Imported content originates from third parties and may be inaccurate, incomplete, outdated, copyrighted, unavailable, or changed without notice.

Kaun does not guarantee the accuracy, completeness, legality, availability, or suitability of third-party recipe content.

You are responsible for ensuring that your use of imported or third-party content complies with applicable law and the rights and terms of the relevant third party.

Kaun does not claim ownership of third-party content merely because it is displayed or processed by the Service.

10. Kaun Plus

Kaun Plus is an optional paid subscription that provides access to additional features and higher usage limits.

Current Free and Plus limits may include:

The 20-recipe Free limit applies to recipes you create or remix. URL imports and share-link imports do not count toward that limit.

Limits and features may change as the Service develops. Any applicable limits presented in the application or store listing at the time of use will control.

Kaun Plus is bound to your signed-in Kaun account. Kaun does not currently offer Family Sharing as a Kaun feature.

11. Subscription Billing

Kaun Plus is offered through Apple's App Store and Google Play, as applicable.

Subscriptions may be offered on monthly or yearly billing periods.

The applicable price is displayed to you through the relevant store before you confirm a purchase. Prices may vary by country, currency, taxes, store, or other factors determined by the applicable platform.

Kaun does not collect or store your payment-card number, CVV, or other direct payment-card credentials for Kaun Plus purchases.

Payment processing, billing, receipts, refunds, taxes, and other payment matters are handled by the applicable app store according to its terms and policies.

Payment is charged through your Apple ID or Google account, as applicable.

12. Automatic Renewal

Kaun Plus subscriptions automatically renew unless you cancel the subscription through the applicable app store before the renewal date.

For Apple subscriptions, auto-renewal must be turned off at least 24 hours before the end of the current subscription period to prevent renewal. Apple may charge your Apple ID within 24 hours before the current period ends.

Google Play subscriptions renew according to Google Play's applicable subscription terms unless cancelled.

Cancellation generally prevents the next renewal but does not normally terminate access to already-paid subscription benefits before the end of the current billing period.

Uninstalling Kaun does not itself cancel a subscription. You must cancel through the store from which you purchased it.

A subscription purchased through Apple cannot be cancelled through Google Play, and a subscription purchased through Google Play cannot be cancelled through Apple.

13. Cancellation and Refunds

You may cancel a subscription through the Apple or Google account used for the purchase.

• Apple: Apple ID → Subscriptions
• Google Play: Google Play → Payments & subscriptions → Subscriptions

Refund requests are handled according to the applicable store's refund policies and applicable law.

Kaun does not promise refunds except where required by applicable law or where the applicable store provides a refund.

Kaun support at support@getkaun.com may help identify a charge or troubleshoot subscription access, but Kaun does not promise that it can reverse a store charge.

Where permitted by the applicable platform, restoring purchases may restore an active Kaun Plus entitlement associated with your Kaun account.

14. Expired Kaun Plus

If your Kaun Plus subscription expires or is cancelled, your account returns to the applicable Free limits.

Kaun does not automatically delete your existing content merely because your Plus subscription ends.

Where technically supported, existing content that exceeds a Free limit may remain accessible and editable. However, you may be prevented from creating additional content that would exceed the applicable Free limit until you return within the limit or subscribe again.

15. No Guaranteed Trials or Promotions

Kaun does not promise that a free trial, introductory offer, promotional price, or other discount will be available.

Any trial or promotional offer shown by an applicable app store or expressly offered by Kaun is subject to the terms displayed with that offer.

16. Apple and Google Terms

Your use of Kaun through Apple's App Store or Google Play is also subject to the applicable platform's terms, rules, and policies.

Apple and Google may impose additional requirements concerning downloads, purchases, subscriptions, refunds, updates, and use of the application.

For iOS, Kaun uses Apple's Standard EULA rather than a separate custom Kaun EULA.

Where an app-store rule directly governs a matter concerning the distribution or purchase of Kaun through that store, the applicable store rule controls to the extent required.

17. Intellectual Property

Kaun and its underlying software, design, branding, logos, interfaces, original text, graphics, and other materials provided by Kaun are owned by or licensed to Hans Wilhelm Beramo Salangsang, doing business as Kaun, and are protected by applicable intellectual property laws.

Except for the limited rights expressly granted to you under these Terms, no ownership rights are transferred to you.

You may not copy, reproduce, modify, distribute, sell, license, publicly display, or commercially exploit Kaun's proprietary materials without permission, except where applicable law permits otherwise.

"Kaun" and related branding may not be used in a way that suggests endorsement, sponsorship, or affiliation without permission.

18. Third-Party Services

Kaun relies on third-party providers to operate portions of the Service, including infrastructure, authentication, analytics, crash reporting, subscription management, email delivery, and content storage.

Those services may have their own terms and privacy policies.

Kaun is not responsible for failures, outages, policy changes, or actions of third-party services outside Kaun's reasonable control.

19. Availability and Changes

We aim to keep Kaun available and functioning reliably, but we do not guarantee uninterrupted or error-free operation.

The Service may be unavailable because of maintenance, updates, infrastructure failures, third-party outages, security incidents, network problems, or circumstances outside our reasonable control.

We may modify, suspend, or discontinue all or part of the Service when reasonably necessary, including for security, legal, operational, or product-development reasons.

20. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

KAUN DOES NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE.

KAUN DOES NOT GUARANTEE THAT ANY RECIPE, INGREDIENT, NUTRITIONAL INFORMATION, COOKING INSTRUCTION, IMPORTED CONTENT, TAG, FILTER, OR OTHER INFORMATION WILL BE ACCURATE, SAFE, SUITABLE, OR APPROPRIATE FOR YOUR PARTICULAR CIRCUMSTANCES.

YOU ARE RESPONSIBLE FOR VERIFYING INGREDIENTS, ALLERGENS, FOOD-SAFETY REQUIREMENTS, COOKING TIMES AND TEMPERATURES, AND OTHER INFORMATION BEFORE PREPARING OR CONSUMING FOOD.

NOTHING IN KAUN IS INTENDED TO PROVIDE MEDICAL, HEALTHCARE, NUTRITIONAL, OR PROFESSIONAL ADVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAUN DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAUN AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF KAUN AND ITS OPERATOR FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID TO KAUN FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
2. PHP 1,000.

IF YOU HAVE USED THE SERVICE ENTIRELY FOR FREE AND HAVE NOT PAID KAUN ANY AMOUNT, THE MAXIMUM LIABILITY WILL BE PHP 1,000, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

These limitations do not apply to liability that cannot lawfully be limited or excluded under applicable law.

Nothing in these Terms excludes or limits mandatory consumer rights or other rights that applicable law does not permit us to exclude or limit.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kaun and its operator from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

• your unlawful use of the Service;
• your violation of these Terms;
• your User Content;
• your infringement or violation of another person's rights; or
• your misuse of the Service.

This obligation applies only to the extent that your conduct caused or materially contributed to the relevant claim.

Kaun may assume control of the defense of a claim subject to indemnification, and you agree to reasonably cooperate with that defense. You may not settle an indemnified claim in a way that imposes liability or an admission on Kaun without Kaun's consent.

23. Suspension and Termination

You may stop using Kaun at any time.

We may suspend or terminate your access to all or part of the Service if reasonably necessary because of:

• a material violation of these Terms;
• unlawful or fraudulent activity;
• abuse of the Service;
• security risks;
• requests from law enforcement or legal requirements; or
• circumstances that materially threaten Kaun, its users, or its infrastructure.

Where reasonably practical, we may provide notice before taking action, but we may act immediately where necessary to address security, fraud, legal, or other serious risks.

Termination does not automatically cancel a subscription purchased through Apple or Google. You must cancel the subscription through the applicable store.

Deleting an account does not necessarily delete locally stored data from your device. It also does not necessarily cause third-party services to immediately erase information they are independently required or permitted to retain.

24. Account Deletion

You may request deletion of your Kaun account through the mechanisms made available by Kaun.

Account deletion may remove or disable server-side account information associated with the account, subject to information that Kaun or its service providers are required or permitted to retain for legal, security, fraud-prevention, dispute-resolution, accounting, or other legitimate purposes.

Account deletion does not function as a remote wipe of your device. Local Kaun data may remain on your device unless you separately delete it.

Account deletion does not automatically cancel Kaun Plus. You must cancel the subscription through Apple or Google. Account deletion also does not automatically delete existing share links.

25. Changes to These Terms

We may update these Terms when reasonably necessary to reflect changes to the Service, law, security practices, or business operations.

If a change is material, we may provide notice through the Service, website, or another reasonable method.

The updated Terms will become effective on the stated effective date.

Your continued use of Kaun after the updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

26. Governing Law and Venue

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.

Subject to any mandatory consumer-protection or other legal rights that cannot be waived, disputes arising from or relating to the Service or these Terms will be subject to the courts of San Jose del Monte City, Bulacan, Philippines.

Nothing in this section prevents you from exercising a mandatory right or pursuing a claim in a forum where applicable law requires that you be permitted to do so.

27. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms constitute the agreement between you and Kaun concerning your use of the Service, except for additional terms that expressly apply to particular features, purchases, or third-party services.

You may not transfer your rights or obligations under these Terms where prohibited by law. Kaun may transfer or assign its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or similar transaction, subject to applicable law.

28. Privacy

Our collection and use of personal information is described in the Kaun Privacy Policy.

By using Kaun, you acknowledge that you have had an opportunity to review that Privacy Policy.
